People get hurt at work every day in the
United States, but not everyone has the clarity of mind to do what they need to
get compensation for their injuries. It can be difficult to prove that your
injuries happened at work, especially if they are reoccurring. There are some
important preliminary steps when you’ve been injured at work.
Act Quickly
It is important that you perform each step
shortly after you get injured. Though it may seem daunting to take on the legal
work just after being injured, you will need to do so. That is not to say one
should push their physical limitation, but because your body is constantly
healing, the longer you wait the more difficult it is to prove the extent of
your injuries and that they happened at work.
Don’t Tough It Out
It is often tempting for people, especially
those working in high risk industries, to downplay their injury and to continue
working. Though this may seem noble, it will likely do more harm than good. If
you are hurt at all, report it. If it turns out not to be a problem, that’s
wonderful. If your condition gets worse though, you will want to have your
original injury documented.
Report The Injury
Be sure to report the injury to your employer
soon after it happens. The best way to do this is through written communication
to ensure you have proof that the conversation happened if you are going to be
getting compensation. Doing this is via e-mail is ideal as it ensures both
parties will have record of the report.
Go To A Doctor
Make sure you get to a doctor as soon as
possible. Even if your injury isn’t an emergency, you will need to go to a
doctor right away to get their assessment of your injuries. Though you may have
witnesses to your injury, a doctor will always be reputable in a court of law.
They will be able to describe exactly the extent of injuries and how they have
placed limitations on you.
Talk To A Lawyer
After you have taken the above steps, talk to
a lawyer about your case. It is difficult to know what you are entitled to, so
you will want the advice of an expert. When you see them, give them all the
information you have about the case, and bring along any evidence you have.
After that, let them guide you through the process of getting the compensation
you’re entitled to.
